1. Agreeing to These Terms

We may revise these Terms occasionally as our services or legal obligations evolve. Any update will be reflected in the "Last Updated" date above. Continuing to use our Services after a change means you accept the revised Terms, so it's worth checking back periodically.

3. What We Offer

NexiFire Publishing provides book publishing, ghostwriting, editing, cover design, illustration, formatting, audiobook production, translation, distribution, and marketing services. References to "Services" throughout this document cover everything we offer through our website and any related platforms used to deliver your project.

4. Text Messaging (SMS) Terms

If you provide your phone number, you're consenting to receive service-related SMS/MMS messages from NexiFire Publishing, such as booking confirmations, reminders, and support responses. Standard message and data rates from your carrier may apply.

You can opt out anytime by replying "STOP" to any message; we'll confirm the opt-out via SMS. To resume, reply "UNSTOP." Need help? Reply "HELP" or email contact@nexifirepublishing.com.

We're not responsible for messages delayed or lost due to carrier issues.

5. Ownership & Intellectual Property

Everything on our website, text, graphics, logos, and branding, belongs to NexiFire Publishing or our licensors and is protected under copyright and trademark law. You may not copy, redistribute, or otherwise use this content without our written permission.

Ownership of your project's deliverables: Once a project is paid in full, ownership of the final deliverables transfers entirely to you, the client, unless we've agreed to something different in writing. Until payment is complete, NexiFire Publishing retains ownership of the work produced.

You're responsible for making sure your use of anything we deliver complies with applicable copyright, IP, and privacy laws. NexiFire Publishing isn't liable for claims of infringement, defamation, or other legal issues arising from how you use the final deliverables.

6. Content You Share With Us

If you send us content, manuscripts, photos, testimonials, or anything else, through our website, email, SMS, or any other channel, you're granting NexiFire Publishing a worldwide, non-exclusive, royalty-free license to use, reproduce, and reference that content in connection with delivering your Services and, where relevant, our own marketing (we'll always seek your consent before featuring your specific project publicly).

7. Privacy

Our Privacy Policy explains how we collect and handle your personal information. Using our Services means you've read it and agree to it.

8. No Guarantee of Information Accuracy

We do their best to keep the information on our website and in communications accurate and current, but we don't guarantee it's complete or error-free. Any decisions you make based on that information are at your own risk.

9. Limits on Our Liability

Creative work, ghostwriting, editing, design, and publishing are inherently subjective, so we can't promise specific outcomes like book sales, search rankings, or audience reception. Results depend heavily on factors outside our control.

By using our Services, you agree that NexiFire Publishing is not liable for:

• Financial outcomes tied to your project (book sales, royalties, marketing performance, etc.)
• Any indirect, incidental, or consequential damages related to your use of our Services, including lost profits or opportunities

To the fullest extent the law allows, NexiFire Publishing and its team, officers, and partners won't be liable for indirect, special, or punitive damages arising from your use of our Services. Our total liability in any circumstance is capped at the amount you actually paid us for the relevant Service.

10. Refunds

We want you to be genuinely satisfied with your project, and refunds are considered under these circumstances:

Unresolved dissatisfaction after revisions. If you've clearly communicated specific concerns during the revision process and they weren't addressed, a partial refund may be appropriate.

Repeated missed deadlines. If we miss agreed deadlines multiple times without notice or a revised agreement, a partial or full refund may be considered depending on the impact.

Timely communication matters. Refund requests tied to quality concerns need to be raised during the project, while there's still a chance to fix them. A refund request that arrives only after the project's been cancelled, with no earlier mention of concerns, generally won't be approved.

Refunds are not issued for:

• Scope or direction changes requested after work has already begun
• Delays or indecision on the client's side
• Subjective preference changes that weren't part of the original agreement
• Reasons unrelated to actual quality or timeliness issues

11. Payments & Disputes

Payments are due according to the schedule agreed at project start. If a payment dispute or chargeback arises, we'll first ask that you contact us directly to work it out. If a chargeback is filed without any prior communication, rights to the delivered work revert to NexiFire Publishing until the matter is resolved. We reserve the right to pursue appropriate legal remedies in the event of unresolved payment disputes.

12. No Return-on-Investment Promises

We don't guarantee any specific return on investment. Book sales, visibility, and audience response depend on market conditions, reader behavior, and platform algorithms, none of which we control.

13. Governing Law

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules. Any disputes will first go through mediation before either party pursues litigation, and any legal proceedings will take place in the state or federal courts of Florida. The prevailing party in any dispute is entitled to recover reasonable attorneys' fees and costs.
